Our real estate group has unique insight and extensive experience in property zoning law. Our attorneys appear before local elected officials and their planning and zoning commissions and have a broad knowledge of all land use matters. Because our team consists of seasoned transactional attorneys, they are able to analyze and negotiate the resolution of high priority issues, make thoughtful recommendations, help prepare presentations before public bodies and advise our clients on the best strategy to achieve land use and business objectives.

Our attorneys have a wide array of experience in drafting and negotiating commercial leases for our real estate clients. We assume all the necessary responsibility to draft lease agreements that not only meet our clients’ specific business objectives but ensure all their legal rights are protected. In some instances we provide services to property owners such as drafting application forms for evaluating credit worthiness of potential tenants or drafting regulations governing usage of rental property. In addition, we often handle matters related to property eviction such as “orders of possession” and any related judgements. This expertise applies to landlords with a rental dispute, or to private and commercial tenants who have been served with an eviction notice. Our real estate attorneys can mitigate losses and provide the necessary guidance throughout the eviction process.

Our real estate attorneys represent developers, property owners, individual contractors, and material suppliers and other entities who are involved in the process of residential homebuilding and construction. Our highly capable team routinely handles matters related to workmanship issues, governmental approvals and permitting, payment disputes, homeowner and subdivision claims, OSHA violations, sub-contractor liability issues and mechanical liens.

Lien claims are technically very demanding and require proper documentation, precise timing, and careful attention to the detailed requirements of Ohio’s mechanic’s lien statute. Our real-estate attorneys provide assistance to our clients to establish basic lien compliance procedures, review and filing of necessary documentation, in addition to handling of litigation when necessary.

Our real estate attorneys handle all aspects of commercial loans, real estate mortgage financings and structured finance transactions, including accounts receivable financing, conduit & permanent financings, syndicated loans, lines of credit, inventory financing and employee stock option plan financing. We also represent our clients in negotiations regarding the sale and acquisition of participation interests in individual loans and loan portfolios, as well as owned real estate.

Our comprehensive representation includes a bankruptcy and loan workout practice that advises lenders with loans in financial distress, resulting in restructurings, acquisitions and dispositions, auctions, receiverships, and other creditor arrangements. This includes representation of lenders against lender liability claims.

In addition to handling commercial real-estate transactions, in certain instances, our attorneys will support personal real-estate matters. These services include working with builders, real estate agents, families, individuals, business entitities and title companies to ensure our clients’ interests are protected in all transactions related to the building, purchase, and sale of personal real-estate.
